Administrative tribunals: permitted scope is not a blanket service list.

By-Law 4 permits a P1 paralegal to provide legal services in proceedings before tribunals established under Ontario or federal legislation, but the tribunal’s enabling statute, rules, representation requirements and the paralegal’s competence still control each file.

Four checks before accepting a tribunal file

    Confirm that the tribunal—not a court, ministry, internal appeal body or another agency—has authority over the dispute and requested remedy.

  2. 02

    Identify the statute, application or appeal route, limitation period and any mandatory reconsideration or internal-review step.

  3. 03

    Read the tribunal’s current rules on representatives, filing, service, evidence, mediation and hearing format.

  4. 04

    Confirm the representative’s licence scope, competence, insurance and ability to take the file without a conflict.

A common tribunal workflow

Intake

Decision or event under challenge, statutory authority, parties, remedy, deadline and procedural history.

Record

Application, response, disclosure, exhibits, witnesses, expert material where permitted and a clear chronology.

Resolution

Case conference, mediation or settlement may be available, but any terms must fit the tribunal’s authority.

Hearing and review

The hearing method, reconsideration, appeal or judicial-review route depends on the governing statute and rules.

Why the answer is always case-specific
